Widerspruch einfach online einreichen

Es ist schnell passiert: Geschwindigkeitsbegrenzungen wirken nicht an allen Stellen angemessen, zumindest aus subjektiver Sicht, und bei freier Fahrt ist das Tempolimit schnell überschritten. Für Tuning-Fans ist dieses Risiko umso größer, da schon ein kurzer Tritt aufs Gaspedal reicht, um jenseits der erlaubten Geschwindigkeit zu fahren. Blitzt es dann auf, steht fest, dass die Übertretung Folgen haben wird. Abgesehen von der Geschwindigkeit gibt es noch andere potenzielle Fehlerquellen, etwa das Übersehen eines Stoppschilds oder zu dichtes Auffahren.

All diese Vergehen ziehen Strafzahlungen nach sich, im schlimmsten Fall sogar Punkte in Flensburg. Mit dieser Gewissheit müssen Fahrer in den meisten Ländern der Welt leben, das anschließende Prozedere wird deswegen zähneknirschend angenommen.

Doch nur die wenigsten Autofahrer wissen, dass jeder zweite Bescheid fehlerhaft ist. Diese Quote ist extrem hoch und bedeutet, dass betroffene Fahrer Bußgeld anfechten können: Auf dem klassischen Weg geschieht das mit rechtlicher Beratung, alternativ bieten sich Online-Plattformen wie myright.de an. Die Erfolgsquote ist in jedem Fall individuell, grundsätzlich gilt allerdings, dass fehlerhafte Bescheide keinen Bestand haben, falls sie formell korrekt angefochten werden.

Gegenkontrolle empfohlen: Bußgelder sind keine Kleinigkeiten

Und das lohnt sich durchaus. Der Blick auf den bundeseinheitlichen Bußgeldkatalog macht das deutlich: Zu geringer Abstand zum Vorderfahrzeug ab 80 km/h kostet mindestens 75 Euro und einen Punkt in der Kartei, Geschwindigkeitsüberschreitungen kosten innerorts 80 Euro ab 21 km/h zu viel. Wer eine rote Ampel überfährt, zahlt 90 Euro und erhält ebenfalls einen Punkt. Und das Missachten der Vorfahrt kostet mindestens 100 Euro inklusive Punkt, falls dadurch ein Vorfahrtberechtigter behindert wurde.

Die meisten Vergehen werden nicht bewusst begangen und oft können sich die Empfänger des Schreibens nicht einmal daran erinnern. In diesen Fällen macht es umso mehr Sinn, den Tatbestand auf seine Korrektheit zu überprüfen. Es kann bereits ausreichend sein, wenn der Fahrer auf dem Foto nicht klar erkennbar ist. Ein weiterer Faktor ist die Zeit: Liegen zwischen dem Tag des Vergehens und der Zustellung des Bescheids mindestens drei Monate, gilt die Tat als verjährt. Und selbst eine falsche Adresse kann ausreichen, um das Verfahren einzustellen. Die Wahrscheinlichkeit, dass eine dieser Situationen rund um den Bußgeldbescheid zutrifft, ist keineswegs gering und sollte deswegen immer überprüft werden.
